These are the Terms and Conditions of Service that regulate the provision of painting and decorating services by Marquina Contractors Ltd. (also referred to as the "Company" or "Contractor") to its customers (the "Customer"). By accepting a quote or booking with the Company, the Customer agrees to be bound by these terms and conditions.

Definitions: A) The Company/Contractor: Marquina Contractors Ltd. B) The Customer: The person(s) or organization for whom the Company agrees to carry out labour and/or supply materials.

Consumer Rights: Consumer Rights Act 2015 

• The Customer acknowledges that the final price quoted may vary if any additional work is required or if there are any changes to the original agreement, and agrees to pay any additional costs incurred.
• The Company shall not be held liable for any damage caused by the Customer's failure to disclose any relevant information about the premises where the work is to be carried out, including but not limited to the presence of asbestos or other hazardous materials.
• The Customer agrees to provide access to the premises during normal business hours, unless otherwise agreed in writing.
• The Company reserves the right to suspend or terminate the agreement if the work cannot be carried out due to unforeseen circumstances beyond its control, including but not limited to equipment failure, illness or injury of its workers.
• The Company reserves the right to subcontract any part of the work to a third-party, provided that the subcontractor is properly qualified and experienced to carry out the work to the required standard.
• The Customer agrees to pay any outstanding fees or charges in full within 14 days of the invoice date.If the outstanding balance is not paid within the given timeframe, all discounts will be revoked and an additional cost of 10% over the total amount will be incurred.
• The Company shall not be held liable for any damage caused by the Customer's failure to follow the maintenance instructions provided by the Company after completion of the work.
• The Customer acknowledges that the Company may use photographic or video evidence of the work carried out for marketing or promotional purposes, unless otherwise agreed in writing.
• The Company reserves the right to update or amend these terms and conditions at any time, and the Customer agrees to be bound by the latest version available on the Company's website.
• The Customer agrees to allow the Company to access the premises after completion of the work to ensure that the work has been carried out to the required standard.
• The Customer agrees to pay any additional costs incurred by the Company due to the presence of unforeseen obstacles or hindrances during the course of the work.
• The Customer agrees to provide the Company with a written notice of any complaints or concerns about the work within 7 days of completion of the work. The Company will investigate the matter and take appropriate action to resolve any issues.
• The Customer agrees to allow the Company to display a sign or banner at the premises during the course of the work to indicate that the work is being carried out by Marquina Contractors Ltd.
• The Company reserves the right to charge interest on any outstanding fees or charges at a rate of 8% per annum above the base rate of the Bank of England.
• The Customer agrees to obtain any necessary planning permissions or permits required for the work, and to provide evidence of such permissions or permits upon request.
• The Customer agrees to comply with all relevant health and safety legislation, and to provide the Company with any relevant information or training required for the safe completion of the work.
• The Customer agrees to provide the Company with a safe and secure storage area for any materials or equipment left on site overnight. The Company shall not be held liable for any loss or damage caused to such materials or equipment while left on site overnight.
• The Company reserves the right to charge an additional fee for any work carried out on weekends or public holidays, unless otherwise agreed in writing.
• The Customer agrees to provide the Company with reasonable access to the premises at all times during the course of the work, including outside of normal business hours if required.
• Consultations and Estimates:Phone or online consultations are free of charge.
  Estimates and quotations will cost £50 when the quoted job exceeds £10000 or when more than one visit to the site is required in order to produce a final quote, regardless of the size or cost of the job. This fee will only be charged if the quote is not accepted.
  
• Discounts:All discounts will be revoked, and full cost will apply if the payment terms and conditions have not been met by the Customer.
  
• Booking Fees:To confirm the booking of our services, a minimum booking fee of £50 will be required for jobs quoted between £100 and £3,400, £90 for jobs quoted between £3,401 and £4,999, and 5% of the total amount for jobs quoted £5000 and above.
  Once the booking fee is received, we will arrange a start date that suits the Customer and the Company's schedule within a reasonable timeframe.
  The remaining amount will be split into two installments of 50% each.
  50% of the total amount is due on or before the start date, and the remaining 50% will be payable immediately upon completion of the work.
  
• Payment Methods:For jobs quoted under £600, using any payment method other than cash will incur an additional charge of 3% of the total amount.
  
• Warranty:Marquina Contractors Ltd warrants labour and material for 1 year.
  The responsibility is limited to the supply of labour and materials to the correct detective condition.
  This warranty excludes damages caused by accident/abuse, weather conditions such as temperature changes, or excessive moisture. To avail of the warranty, any damage must be reported immediately after detection. This must be reported in writing via email to [email protected].
